Terms of Service

These terms govern your access to the Lingyuns model gateway, GPU cloud and related services operated by Lingyun Technology inc.

1. Agreement

By creating an account or using the services you agree to these terms on behalf of yourself and any organisation you represent. If you do not agree, do not use the services.

2. Accounts

You are responsible for the accuracy of your registration details, the security of your API keys and all activity under your account. Notify us immediately at [email protected] if a key is compromised; we will revoke it.

Accounts found to be sharing credentials in violation of rate limits or reselling capacity without a partner agreement may be suspended.

3. Acceptable use

You may not use the services to generate unlawful content, to infringe intellectual-property rights, to develop malware, to conduct unauthorised penetration testing, or to violate the terms of the underlying model providers.

Automated abuse, denial-of-service attempts, crypto-mining on non-GPU plans and evasion of usage metering are prohibited.

4. Credits, billing and refunds

Token credits are prepaid and are consumed at the published per-million-token rates. GPU time is billed by the hour or by the reservation term.

Unused credits are refundable within 30 days of purchase, less consumed usage and payment-processing costs. See the service level agreement for service-credit remedies.

5. Model providers

Models are provided by third parties. Rates and availability may change; we will give seven days notice of material pricing changes affecting existing credits.

6. Liability

The services are provided "as is". To the maximum extent permitted by law, Lingyun Technology inc is not liable for indirect, incidental or consequential damages, and aggregate liability is limited to the amounts you paid in the twelve months preceding the claim.

7. Governing law

These terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules. Courts located in Mesa County have exclusive jurisdiction.
